Licensed medical cannabis delivery is an intrastate service. A state-licensed operator may deliver only where its program allows, to an eligible patient or caregiver, using the identification and tracking steps required by that program. Mailing marijuana across state lines remains a separate federal issue.

Texas: delivery is part of the Compassionate Use Program
Texas DPS states that registered employees of licensed dispensing organizations may deliver prescriptions. Remote pickup locations can also be used when the prescription has already been dispensed and labeled for the patient. The patient or legal guardian must be identifiable in the Compassionate Use Registry of Texas before the product is released.
Texas currently identifies licensed organizations on the DPS website. A smoke shop, CBD store, or website selling hemp products is not a Compassionate Use Program dispensary. Start with the official-registry locator, then confirm the operator's delivery area, schedule, fees, and ID procedure. Our Texas access guide explains CURT and qualifying conditions.
North Carolina: statewide medical delivery is not available
North Carolina does not operate a statewide medical marijuana dispensary and delivery program. Bills introduced in the General Assembly are not the same as enacted law. The Eastern Band of Cherokee Indians runs a separate regulated program on sovereign tribal lands at the Qualla Boundary, including medical and adult-use sales through a tribally regulated dispensary.
The EBCI Cannabis Control Board warns that products lawful on tribal lands may be unlawful outside them. A purchase in Cherokee does not create permission to transport marijuana elsewhere in North Carolina or across a state line. Verify current tribal rules through the Board before traveling.
Examples of other state models
- Florida: Licensed medical marijuana treatment centers are the only businesses authorized to dispense medical marijuana and low-THC cannabis to qualified patients and caregivers. The official OMMU page provides a location search.
- Virginia: The Cannabis Control Authority lists licensed medical dispensaries by region. Confirm delivery directly with the licensed operator because service areas and timing can differ.
- New Jersey: The regulator's finder indicates whether a licensed dispensary serves medicinal patients, adult-use customers, or both, and whether delivery is offered.
- Maryland: The official dispensary locator supports search by ZIP code and county. Only a licensed dispensary can make a lawful state-program sale.
- Pennsylvania: The Department of Health publishes a medical dispensary map and a current list of locations with product.
Five checks before placing an order
- License: Match the operator and address to the state regulator's current record.
- Eligibility: Confirm that your patient certification, registry entry, or card is active on the delivery date.
- Address: Ask whether the operator can deliver to that address and whether the patient must be physically present.
- Identification: Know which patient and caregiver IDs the driver must inspect.
- Product record: Compare the label, cannabinoid amounts, route, and quantity with the clinician's recommendation or state order.
Delivery is not the same as shipping
State medical delivery normally uses a registered employee or approved delivery system inside that state. USPS, UPS, and other carriers operate under separate federal and company rules. A website that uses the word delivery may mean local courier service, commercial shipment, or simple pickup scheduling. Ask which method is used before paying.
Watch for common warning signs
Do not rely on a seller that refuses to provide its license number, asks a medical patient to pay through an unrelated personal account, promises interstate marijuana shipment, or claims that a local map listing proves approval. A real regulator page should identify the operator or provide a license search.
